Terms of Use

Please read these Terms of Use ("Terms") carefully before using the Photo & ID Maker mobile application ("App") operated by SimpuMind ("we", "our", or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By accessing or using the App, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you may not use the App. We reserve the right to modify these Terms at any time, and such modifications shall be effective immediately upon posting. Your continued use of the App after any such modifications constitutes your acceptance of the modified Terms.

2. Description of Service

Photo & ID Maker is a mobile application that allows you to:

• Capture or import photos for ID photo creation
• Edit and adjust photos to meet specific ID photo requirements
• Export photos in various formats and sizes
• Access templates for different countries and document types

The App processes photos locally on your device. We do not store, upload, or transmit your photos to our servers.

3. Subscription Terms

3.1 Premium Features

The App offers both free and premium features. Premium features are available through subscription plans or one-time purchases. Subscription plans include:

• Weekly Subscription: Billed weekly, automatically renews unless cancelled
• Monthly Subscription: Billed monthly, automatically renews unless cancelled
• Yearly Subscription: Billed annually, automatically renews unless cancelled

3.2 Auto-Renewal

By purchasing a subscription, you agree that:

• Your subscription will automatically renew at the end of each billing cycle
• You will be charged the subscription fee to your Apple ID or Google Play account
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel your subscription at any time through your device's subscription settings

3.3 Billing

Subscription fees are charged through your Apple ID (iOS) or Google Play account (Android). Payment will be charged to your account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.

3.4 Price Changes

We reserve the right to change subscription prices at any time. Price changes will not affect your current subscription period but will apply to subsequent renewal periods. You will be notified of any price changes before they take effect.

4. Cancellation and Refunds

4.1 Cancellation

You may cancel your subscription at any time:

• iOS: Go to Settings → [Your Name] → Subscriptions → Photo & ID Maker → Cancel Subscription
• Android: Go to Google Play Store → Subscriptions → Photo & ID Maker → Cancel

Cancellation will take effect at the end of your current billing period. You will continue to have access to premium features until the end of the period you have already paid for.

4.2 Refunds

Refund requests are handled by Apple (iOS) or Google (Android) according to their respective refund policies:

• iOS: Contact Apple Support for refund requests. Apple's refund policy applies.
• Android: Contact Google Play Support for refund requests. Google's refund policy applies.

We do not provide direct refunds. All refund requests must be processed through the respective app store. Generally, refunds may be available if requested within a reasonable time after purchase, subject to the app store's policies.

All subscriptions follow the same refund policy as determined by the app store.

4.3 Restore Purchases

If you have previously purchased a subscription or premium features, you can restore your purchases using the "Restore Purchases" feature in the App. This will restore your premium access on new devices or after reinstalling the App.

5. User Responsibilities

5.1 Appropriate Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App to create fraudulent, misleading, or illegal documents
• Use the App in any way that violates applicable laws or regulations
• Attempt to reverse engineer, decompile, or disassemble the App
• Remove or alter any copyright, trademark, or other proprietary notices
• Use the App to infringe upon the rights of others

5.2 Photo Content

You are solely responsible for the photos you process using the App. You represent and warrant that:

• You have the right to use and process the photos
• The photos do not violate any laws or infringe upon any third-party rights
• The photos are not illegal, obscene, defamatory, or otherwise objectionable

5.3 ID Photo Requirements

While the App provides tools to help you create ID photos, you are responsible for ensuring that the final photos meet the specific requirements of the issuing authority (government agency, passport office, etc.). We do not guarantee that photos created with the App will be accepted by any authority.

6. Intellectual Property

6.1 App Ownership

The App, including all content, features, functionality, and software, is owned by SimpuMind and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 User Content

You retain all rights to the photos you create using the App. By using the App, you grant us a limited, non-exclusive license to process your photos locally on your device solely for the purpose of providing the App's functionality. We do not claim ownership of your photos.

6.3 Third-Party Content

The App may include templates, designs, or other content that is licensed from third parties. Such content remains the property of its respective owners and is subject to their own terms and conditions.

7. Limitation of Liability

7.1 Service Availability

We strive to provide a reliable service, but we do not guarantee that the App will be available at all times or that it will be free from errors, bugs, or interruptions. We reserve the right to modify, suspend, or discontinue the App at any time without notice.

7.2 Photo Processing Accuracy

While we make every effort to ensure the App processes photos accurately, we do not guarantee that:

• Photos will meet all requirements of any specific authority
• Photos will be accepted by any government agency or organization
• The App will detect all issues or errors in photos

You are responsible for verifying that your photos meet all applicable requirements before submission.

7.3 Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

7.4 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE APP.

8. Indemnification

You agree to indemnify, defend, and hold harmless SimpuMind and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the App or violation of these Terms.

9. Termination

We reserve the right to terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will cease immediately.

10. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved through appropriate legal channels in the jurisdiction where SimpuMind operates.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the App after any such modifications constitutes your acceptance of the modified Terms.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

13. Entire Agreement

These Terms constitute the entire agreement between you and SimpuMind regarding the use of the App and supersede all prior agreements and understandings.
